Recently, the Arizona Supreme Court issued a decision regarding incentives worth $2.6 million, given to a private university by the City of Peoria. The deal was contested by the Goldwater Institute, representing Darcie Schires, et al, and on February 8 the Court held that the City’s payment violated the gift clause. This panel will examine the City’s decision to grant the incentives, the process whereby they were challenged, the Court’s decision, and ultimately the chilling effect this erosion of available economic tools may have on future development.
